GENERAL TERMS AND CONDITIONS OF SERVICE
  1. SCOPE OF APPLICATION
    These general booking terms and conditions (GTC) apply to the Hotel St. Pankraz, located at Widumanger 3, St. Pankraz, for the provision of rooms to customers, as well as for all services and supplies provided by Herbert Schwienbacher. The German version is authoritative.

  2. CONTRACT CONCLUSION
    A single reservation without a guarantee is valid until 4:00 PM on the day of arrival. With a specific guarantee, the customer's reservation is valid for the entire night even after 4:00 PM. Guarantees for a reservation include:
    1. Credit card (Visa, Mastercard)
    2. Advance payment of at least 30% of the booking amount, for example, via bank transfer or postal transfer
    3. Written guarantee in the form of a booking confirmation from a company registered in the commercial register, with headquarters in Italy

      An offer for group bookings is explicitly marked as such and must be confirmed by the customer and returned to the issuing accommodation provider. An offer is valid for 7 days (acceptance period). In particular, this means that packages, price lists, and similar issued by the operator do not constitute a binding offer. Herbert Schwienbacher expressly reserves the right to resell the rooms during and after the acceptance period for group booking offers. In case of a new request, the new offer may differ from the first.

  3. SERVICES AND PRICES
    The customer does not acquire any right to the provision of specific rooms, but Herbert Schwienbacher commits to providing rooms of the reserved category. If, upon arrival, a room of the same booked category is not available due to unforeseen reasons, accommodation will be provided in a room of the same or higher category. The customer is obliged to pay the current or agreed prices of Herbert Schwienbacher for the provision of rooms and other used services. This also applies to services and expenses incurred by Herbert Schwienbacher at the customer's request. Prices are in EURO, per room/night, including breakfast or half board. Drinks consumed at the bar or restaurant, any specific additional services, and the tourist tax per person per night are not included in the price.

  4. ROOM DELIVERY AND RETURN
    Booked rooms are available to the customer from 3:00 PM on the agreed arrival day. The customer has no right to earlier occupation of the room. In case of late arrival, check-in can be done until 10:30 PM. For later arrivals, please call. On the agreed departure day, rooms must be vacated by 11:00 AM at the latest. After this time, the company may charge 50% of the full room price for the use beyond the contractual period until 6:00 PM, and 100% after 6:00 PM.

  5. PAYMENT
    Invoices from Herbert Schwienbacher without a due date are payable within 10 days of receipt without deductions. Herbert Schwienbacher has the right to demand immediate payment of outstanding invoices at any time. Herbert Schwienbacher has the right to demand an advance payment or a guarantee upon conclusion of the contract or later. The amount of the advance payment and deadlines will be communicated with the offer. If the customer resides abroad, Herbert Schwienbacher reserves the right to charge the full invoice amount to the guarantee credit card. Any exchange rate differences or bank charges are borne by the customer. The customer can only offset with an uncontested or legally binding claim against Herbert Schwienbacher.

  6. CANCELLATION CONDITIONS
    6.1 Cancellation Conditions for Individual Bookings Individual bookings are generally considered final once the offer from Herbert Schwienbacher is confirmed. In case of short-term cancellation after the cancellation deadline, up to 100% of the booked amount may be charged. The following guidelines apply:
      • Up to 30 days before arrival, guests can cancel free of charge.
      • The guest pays 50% of the total price for cancellations within 30 days before arrival.
      • In case of no-show, the guest pays the total price of the reservation.
        European hotel contract conditions apply. Please understand that cancellations are only accepted in written form. It is recommended to take out cancellation insurance.
        6.2 Cancellation Conditions for Groups Cancellation conditions for group bookings depend on the group size and are regulated separately. If no separate cancellation conditions are present, the following rules apply:
      • Cancellation up to 60 days before arrival is free of charge.
      • Cancellation up to 30 days before arrival: 50% of the total expected revenue.
      • Cancellation up to 14 days before arrival: 100% of the total expected revenue.

  7. WITHDRAWAL
    If the customer has the right to free cancellation according to point 6 above or a separate agreement, Herbert Schwienbacher is entitled to withdraw from the contract during this period if there are inquiries from other customers for the contractually booked rooms and the customer, upon request from Herbert Schwienbacher, does not waive their right to free cancellation. If an agreed advance payment is not made even after a reasonable deadline set by Herbert Schwienbacher, Herbert Schwienbacher is entitled to withdraw from the contract. Furthermore, Herbert Schwienbacher is entitled to withdraw from the contract for justified reasons, for example, if:
      • Force majeure or other circumstances not attributable to Herbert Schwienbacher make the fulfillment of the contract impossible.
      • Rooms are booked with misleading or false statements of essential facts, such as the customer or the purpose.
      • Herbert Schwienbacher has reason to believe that the use of the service may endanger the normal operation, security, or reputation of Herbert Schwienbacher in public, without this being attributable to the control of Herbert Schwienbacher.
      • There is a violation of point 5 above.
        In case of justified withdrawal by Herbert Schwienbacher, the customer is not entitled to compensation.

  8. TOUR OPERATOR OR GROUP AGREEMENTS
    For bookings of more than four units and contingent contracts, separate payment and cancellation conditions may apply. These will be stated in the corresponding offer. For bookings through a tour operator, the terms and conditions of the respective operator apply.

  9. VOUCHERS
    A voucher purchased from Herbert Schwienbacher can only be used for defined services from Herbert Schwienbacher. If there are remaining balances after payment with the voucher, these balances remain and can be used for further bookings at Herbert Schwienbacher, if available at the selected facility. Vouchers cannot be exchanged for cash, returned, resold, or transferred. The customer ordering the voucher is responsible for providing correct information (especially the email address) to which the voucher and invoice should be sent.

  10. EXTRA BEDS / CHILDREN
    Upon request, in designated categories, a sofa bed or extra bed can be provided. Children are welcome from 0 years and up. Children up to 2 years stay free of charge. Reduced prices apply for children of other age groups. An additional charge of €10 applies for extra beds for children.

  11. PETS
    Upon request and subject to availability, dogs are generally allowed. The price is €15.00 per room/night, excluding food.

  12. QUIET HOURS AND PARTIES
    Any noise must be avoided in common areas, private areas, and surrounding grounds. Complete silence must be observed from 10:30 PM to 6:00 AM unless a collective exception is expressly agreed by the Hotel St. Pankraz management. Violation of quiet hours and the holding of parties constitute misuse of the facilities and will be penalized with a fine of €500.00. Any additional cleaning costs and revenue losses resulting from the inability to rent the facility or claims for damages from other guests are expressly reserved.

  13. PROMOTIONAL COMMUNICATIONS
    Customers of Herbert Schwienbacher can choose to receive promotional communications. If the customer wishes to receive such communications, they will only come from Hotel St. Pankraz, as customer data will not be shared for marketing purposes with third parties. Receiving such promotional communications can be deactivated at any time by sending a written request to info@hotel-st-pankraz.com.

  14. REVIEWS
    Customers of Herbert Schwienbacher and Hotel St. Pankraz are invited to make truthful statements in reviews on third-party portals. Defamatory and/or untruthful statements will be reported to the competent authorities under applicable law. Guests are also asked to disregard reviews made before 01.05.2024, as they do not fall under Herbert Schwienbacher's scope.

  15. CUSTOMER DATA
    Herbert Schwienbacher is required to collect the customer's email address and phone number to ensure communication with the guest. To verify the guest's identity, Herbert Schwienbacher is obliged by the authorities to request a valid identification document (ID card for EU citizens or passport for EU and non-EU citizens), copy it, and send it to the Italian State Police. Herbert Schwienbacher reserves the right to cancel a booking if the guest's identity cannot be clearly established due to missing or false documents. Herbert Schwienbacher uses software solutions that calculate a so-called "Fraud-Prevention-Score" for each customer to avoid fraudulent bookings. These software solutions require data such as email address, residential address, phone number, credit card, etc. Herbert Schwienbacher reserves the right to cancel the booking if the software detects a fraudulent booking.

  16. WEBSITE TERMS OF USE AND PRIVACY POLICY
    These GTC for transactions must be read in conjunction with the terms of use and privacy policy of the company or facility website. The GDPR applies. The privacy policies of Herbert Schwienbacher are available at https://www.hotel-st-pankraz.com/en/agb.html.

  17. LIABILITY / DUTY OF CARE
    The infrastructure and equipment must be used by the customer with the utmost care. Damages caused must be compensated by the customer or company. Herbert Schwienbacher assumes no liability for theft, etc., and for third-party services. Furthermore, the facility is only liable for direct intentional or grossly negligent damages, contractual or extra-contractual. Any other liability is excluded.

  18. SUDTIROL-GUEST-PASS
    - Upon completion of the accommodation contract, the Südtirol Alto Adige Guest Pass (consequently Guest Pass) will be issued to the guest, which according to the decision of the South Tyrolean regional government No. 732/2022, is valid for the entire duration of their stay as well as from 0:00 on the day of arrival unto 24:00 on the day of departure.
    - The Guest Pass includes the use of all public transport within the “südtirolmobil” network area as well as additional services, which vary depending on the tourism organization. Detailed information can be found at: suedtirol-guestpass.info
    - The sole entity carrying the Guest Pass in South Tyrol is the Mobilitätskonsortium, appointed as the unified coordination point in accordance with the above decision of the South Tyrolean regional government by the Provincial Association of Tourism Organizations of South Tyrol on November 16, 2022.The details of the additional services associated with the Guest Pass and the conditions of use of the Guest Pass are communicated by the third party responsible for issuing and managing the Guest Pass.   19. FINAL PROVISIONS
    In addition to the GTC, additional booking terms and conditions may apply that prevail over the GTC. Changes or additions to the accepted offer or these GTC must be made in writing. Unilateral changes or additions by the customer are not valid. The place of performance and payment is the location of Hotel St. Pankraz. Italian law applies with exclusive jurisdiction in Bolzano. If individual provisions of these GTC are or become ineffective or null, this does not affect the validity of the remaining provisions. Otherwise, the statutory provisions apply.
